1. General

These Terms & Conditions (“Terms”) govern all purchases of products and services through the website evclinic.eu (the “Website”), operated by EVC RESEARCH & DEVELOPMENT d.o.o. za usluge, Ljubljanska ulica 7, 10431 Sveta Nedelja, Croatia, OIB: 32246144302, VAT ID: HR32246144302, registered at the Commercial Court in Zagreb under MBS 081622773 (“EVC”, “we”, “us”). By placing an order on the Website, you confirm that you have read and accepted these Terms, together with our Refund & Return Policy, Shipping Policy and Privacy and Cookie Policy.

2. Products and services

Through the Website, EVC offers:

Physical products – repair kits, diagnostic tools and related hardware;
Repair services – repair, remanufacturing and technical analysis of electronic modules and components sent to our workshop;
Digital file services – software-based error reset and configuration services delivered electronically;
EVC Tokens – prepaid credits that can be redeemed against EVC products and services;
Training – EVC Academy training programmes.

Professional use notice: Our repair kits, tools and file services are intended for trained professionals. Work on high-voltage systems of electric and hybrid vehicles is dangerous and may cause serious injury or death if performed without adequate qualification and equipment. By purchasing, you confirm that installation and use will be carried out by qualified personnel in accordance with applicable safety regulations.

3. Prices and payment

All prices are displayed in euros (EUR), both inclusive and exclusive of Croatian VAT (25%). The price applicable to your order is the price displayed at the time the order is placed. Shipping costs, where applicable, are shown separately at checkout before payment.

Accepted payment methods are displayed at checkout and may include card payment and bank transfer. Orders are processed after payment has been received.

4. Ordering and contract conclusion

An order placed through the Website constitutes an offer to purchase. The contract is concluded when we confirm the order by e-mail. We reserve the right to decline an order in case of obvious pricing errors, unavailability of stock, or suspected fraud; any amount already paid will be refunded in full.

5. Repair services

For repair services booked through the Website, you ship the component to our workshop at your own cost and risk, following the instructions provided after booking. After inspection, we confirm the diagnosis and final price before performing work that exceeds the scope or price stated on the Website. If a component is found to be unrepairable, we will inform you and either return the component or, at your request, dispose of it; a diagnostic fee of [IZNOS ILI “as stated in the service description”] may apply.

Repair services are covered by a warranty of [12/24] months on the work performed and parts replaced, under the conditions stated in the service description.

6. Digital file services

Digital file services are performed electronically after you submit the required data or files. By ordering a digital file service, you expressly request immediate performance and acknowledge that, once the service has been fully performed, the statutory right of withdrawal no longer applies (see Refund & Return Policy).

7. EVC Tokens

EVC Tokens are prepaid credits redeemable against EVC products and services. Tokens are valid for [ROK, npr. 24 mjeseca] from purchase, are not transferable and cannot be exchanged for cash, except where required by mandatory consumer law.

8. Legal guarantee of conformity

Consumers within the European Union benefit from the statutory guarantee of conformity for goods of two years from delivery, in accordance with Croatian and EU consumer protection law. This legal guarantee is independent of any commercial warranty we may offer.

9. Liability

Nothing in these Terms limits liability that cannot be limited under applicable law. Subject to that, EVC is not liable for damage resulting from improper installation, use contrary to instructions, use by unqualified persons, or modifications made by third parties. Technical articles and publications on the Website are provided for information only and do not constitute advice for any specific vehicle or repair.

10. Intellectual property

All content on the Website, including repair procedures, diagnostic data, documentation, software and media, is the intellectual property of EVC RESEARCH & DEVELOPMENT d.o.o. or its licensors and may not be reproduced or commercially used without prior written consent.

11. Complaints, governing law and disputes

Written complaints may be submitted to [EMAIL] or by post to our registered office. We will respond in writing within 15 days of receipt, in accordance with the Croatian Consumer Protection Act.

These Terms are governed by Croatian law. For consumers, mandatory provisions of the law of their country of residence remain unaffected. Disputes fall under the jurisdiction of the competent court in Zagreb, unless mandatory law provides otherwise. Consumers in the EU may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
